Assumption of Risk, Release and Indemnification

BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT –PLEASE READ CAREFULLY!

In consideration of using the service, equipment and facilities of The Paint Riot  (hereinafter “TPR”), I hereby acknowledge and agree to the following terms and conditions:

In this Release Agreement, the term “Activities” shall include but shall not be limited to all activities, functions, events, orientations, instruction sessions, competitions and services provided, arranged, organized, sponsored or authorized by TPR, including but not limited to: paint, splattering and playing inside The Paint Riot with one or more instrument(s), including, but not limited to a canvas, paint brushes, and paint bottles in a designated room, and other related activities.

1. ASSUMPTION OF RISK

By signing below, I acknowledge that participation in any activity at The Paint Riot (hereinafter “TPR”) may include physical exertion, use of various art materials (including paint, kinetic sand, water, UV-reactive substances, etc.), interactive equipment, loud noise, bright or dim lighting, and other stimulating experiences. Risks may include, but are not limited to:

• Slips, trips, or falls on wet or paint-covered surfaces

• Eye or skin contact with non-toxic paint or art materials

• Sensory overload from lights, noise, or textures

• Staining or damage to personal clothing or property

• Accidental impact with walls, props, or other participants

I understand that children under the age of 5 years old are not permitted in the splatter room. Children must be supervised by a parent or guardian at all times.

2. PPE AND SAFETY ACKNOWLEDGMENT

I acknowledge that TPR provides optional personal protective equipment (PPE), including ponchos or coveralls, and shoe covers. Goggles are required and will be provided. I understand that refusal to wear PPE increases my risk of injury, for which I accept full responsibility.

I agree to use all provided PPE as instructed and acknowledge that TPR is not liable for injury or damage to personal property resulting from improper or refused use of safety gear.

3. MEDICAL CONDITIONS AND CAPACITY TO PARTICIPATE

I certify that I (or my child) am in good health and capable of participating in TPR activities. I understand that TPR staff are not trained medical professionals and are not responsible for managing medical emergencies. I authorize TPR to seek emergency medical treatment on my behalf and assume responsibility for associated costs.

I confirm that neither I nor any child under my supervision is under the influence of alcohol, drugs, or any impairing substances. I understand that appearing intoxicated may result in refusal of service without refund.

4. WAIVER OF LIABILITY & RELEASE

I release and forever discharge The Paint Riot, its owners, employees, contractors, affiliates, successors, and assigns (the “Releasees”) from any and all liability for injuries, losses, damages, costs, or expenses that may occur while participating in TPR activities, whether caused by negligence, breach of contract, or otherwise.

This waiver includes, but is not limited to:

• Personal injury, death, or property damage

• Damage to clothing or personal items

• Emotional distress, allergic reactions, or sensory overload

I agree not to initiate or participate in any legal claims against the Releasees in connection with my participation.

5. INDEMNIFICATION

I agree to indemnify and hold harmless the Releasees from any claims, liabilities, or damages caused by my own conduct, or the conduct of a minor under my care.

6. MEDIA CONSENT AND PRIVACY

I understand that TPR takes photos or video footage for insurance, documentation, or promotional purposes. I grant permission for my image or my child’s image to be recorded. TPR agrees not to publish or publicly use any photos or recordings without first seeking verbal consent.

If I prefer not to be photographed or recorded, I will notify staff at the beginning of the session, and reasonable accommodations will be made.

7. GOVERNING LAW

This agreement shall be governed by and interpreted under the laws of the Province of Ontario.

8. ACKNOWLEDGMENT & UNDERSTANDING

By signing below, I confirm that I have read and understood this waiver, and I agree to be bound by its terms. I am not relying on any verbal statements made by TPR staff. I acknowledge that I am signing this voluntarily and am at least 18 years old or the legal guardian of a participating minor.

BY COMPLETING THIS FORM, I HEREBY ACKNOWLEDGE THAT I AM NOT INTOXICATED NOR HAVE I CONSUMED ANY OTHER SUBSTANCES THAT MAY RESULT IN MY JUDGEMENT BEING IMPAIRED. I HEREBY ASSUME FULL RESPONSIBILITY FOR MY ACTIONS, RISKS, DANGERS, AND HAZARDS RESULTING FROM THE USE OF THE FACILITIES AND PARTICIPATION IN THE ACTIVITIES WHILE UNDER THE INFLUENCE OF ALCOHOL OR MIND-ALTERING SUBSTANCES. I UNDERSTAND THAT I AM GIVING UP CERTAIN RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE. I AM AT LEAST 18 YEARS OLD AS OF THE DAY THIS FORM WAS FILLED OUT. I FREELY ACCEPT AND ASSUME ALL RISKS, DANGERS AND HAZARDS AND THE POSSIBILTY OF RESULTING PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS DIRECTLY OR INDIRECTLY ASSOCIATED WITH MY PARTICIPATION IN THE ACTIVITY. I HAVE READ THIS REALEASE AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS AND VOLUNTARILY AGREE TO ITS TERMS.

I agree to wear all required safety gear provided by TPR, including goggles and a coverall or poncho. If any safety gear is removed, worn improperly, or not used at my discretion, I accept full responsibility for any resulting injuries.

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT AND I AGREE TO BE BOUND BY ITS TERMS.

PARENT’S OR GUARDIAN’S ADDITIONAL AGREEMENT AND INDEMNIFICATION (Must be completed for participants under the age of 18)

In consideration of  (Minor) being permitted to participate in TPR activities and to use its equipment and facilities, I, the parent or guardian of the minor agree on behalf of the minor to the above assumptions of risk, release of liability and waiver of claims and to release, indemnify and hold harmless TPR from any and all claims which are brought by, or on behalf of the minor, and which are in any way connected with such participation or use by the minor. I further certify that I am the parent or guardian of the minor on this agreement and certify that I will be accompanying the minor during their session booked. I hereby give approval to the participation in TPR activities and/or use of its equipment and facilities by the minor.
